Failure to diagnose can result in serious consequences

A failure to diagnose can be serious for several reasons including that it can result in death or a worsened condition for the patient. A failure to diagnose, misdiagnosis or delayed diagnosis can all be serious concerns for victims and their families. Victims and their families may suffer serious damages as a result which is why medical malpractice legal options are available to help.

Some examples of medical malpractice related to a failure to properly diagnose include failure to admit for emergency treatment, failure to order necessary imaging or other emergency room errors; failure to timely diagnose or treat a heart attack which can lead to permanent damages to the heart and other areas of the body or may be fatal; failure to diagnose likely or common complications in certain situations; failure to adhere to the standard of post-surgical care; failure to take patient or family concerns seriously, especially in nursing home settings; failure to recognize a more serious diagnosis; and failure to promptly respond to complications in birth injury situations.

When a failure to diagnose, misdiagnosis or delayed diagnosis results in harm or a worsened condition for the victim, depending on the circumstances, victims and their families may be able to recover compensation for the physical, financial and emotional damages suffered. A medical malpractice claim for damages can assist victims with medical expenses, funeral expenses, lost earnings and pain and suffering damages among other types of damages unique to each situation but generally recognized.

Medical malpractice legal options hold doctors who to fail to provide the commonly expected standard of care to their patients accountable and provide options for victims that may feel vulnerable as they seek medical care and receive substandard treatment. Because of the serious nature of diagnosing errors, it is important for victims to be familiar with legal options available to protect them.
