Texas patients are supposed to be informed of the risks associated with any medical treatment they are to receive. Then, based on the information at hand, they can choose whether they want to confront the potential risks. However, sometimes medical professionals make mistakes that go beyond the risks identified when informed consent is obtained. These surgical errors can cause extensive, sometimes unbelievable, harm.
This was the scenario for one woman who recently succeeded on a medical malpractice lawsuit. The claim was filed after the woman underwent an operation to have an ovarian cyst removed, but eventually had to have her hands and feet amputated due to medical malpractice. According to the lawsuit, the doctor accidentally punctured her bowel. This not only caused the woman’s blood pressure to drop, but it also caused gangrene. As a result, the woman’s hands and feet had to be amputated.
Her legal battle wasn’t quickly resolved, though. In fact, the matter went to trial twice and resulted in hung juries. On the third attempt, a jury found in the victim’s favor, awarding her nearly $110 million. These damages are likely to help address medical expenses and lost wages, as well as damages related to physical and emotional pain and suffering and permanent disfigurement. Although a recovery of this amount is not the norm in these types of lawsuits, it does help highlight just how valuable these claims can be.
The process of filing, negotiating and litigating a medical malpractice claim isn’t easy, though. Doctors and hospitals usually have extensive resources, meaning they have teams of aggressive attorneys ready to help them build their defense. Fortunately, victims can acquire an equally experienced and aggressive advocate who can help them prepare the strong legal arguments they need to maximize their chances of success. The attorneys at our firm are well-versed in providing this type of representation, which is why we encourage those who have been harmed by medical negligence to consider exploring our firm further.
